Windows 10 SP3 pen shutting off

My pen keeps shutting down constantly for a couple seconds to a minute, I replaced the pen, the battery, I remove and reinstall the battery when it shuts down and still nothing, reinstalled the drivers and still fails. Anybody know how to fix the issue?

By shutting down are you saying it disconnects? Try unpairing it, restart your Surface and pair it again.

The "eraser" button works but the pen stops writting, so bluetooth pairing still remains but the actual pen stops working completely.
