It's probably still registered to him as well... so if there's any warranty left I would expect you'll have trouble claiming it. He should remove the device from his Microsoft account.

Yes that would but you also need a bootable USB drive to put the ISO on. There are several options. Check out Rufus, that's a program that will help you to make a bootable flash drive.

Do not recommend going to W10. I would wait a few months and see if Microsoft fix some annoying bugs first. Deeply regret updating to W10 myself, I may invest time this weekend going back to 8.

The media creation tool will make a bootable USB, brain dead simple.

Are there any tricks to getting the surface to boot to the USB.
Yes.
Step 1: Attach a bootable USB device to the USB port.
Step 2: Press and hold the volume-down button.
Step 3: Press and release the power button.
Step 4: When the Surface logo appears, release the volume-down button.
Surface will start the software on your USB device.
