Surface Pro 2: Pen constantly stops working since last update

I've had this odd issue with my pro 2; after turning on my pro 2, if I haven't used the pen for a while, the pen doesn't work unless I restart the device. It is becoming really frustrating. Has anyone else had this issue? any suggestions?

Mine is working fine as of a mystery SP2 specific update that installed yesterday, dated July 8th, which I could've sworn already installed days ago. It was working fine before that as well.

I have an issue where the tablet driver keeps stopping making the pen calibration reset to default and I cant open the wacom control panel. This is fixed after a restart but it can be annoying. Fortunately it doesn't happen too often. I've tried all the usual suspects, reinstalling, uninstalling etc but it still happens.
